Is it a crime? Fifteen-year-old takes and sends nude pics of herself

Authorities in Newark, Ohio have filed felony charges against a 15-year-old girl accused of taking nude cell phone photos of herself and sending them to high school classmates.

According to police, the Newark Licking Valley student was arrested Friday and held over the weekend. On Monday, she entered denials to juvenile charges of illegal use of a minor in nudity-oriented material and possession of criminal tools.

Ohio attorney general’s office spokesperson says an adult convicted of the child pornography charge would have to register as a sexual offender, but a judge would have flexibility on the matter with a convicted juvenile.

A prosecutor says Licking County authorities also considering charges for students who received the photos.

Ok first, I think the girl should be punished in a big way! Although I do have to wonder about the prosecution of those she sent the pictures to. I’d think that would be a little difficult to do unless there was proof they asked for the images. But for them to be prosecuted for ‘receiving’ them, that’s not right.

If you were the parent of the kids who received the images, what would you want the girls penalty to be?

What about if you were the judge? What would you charge her with – besides being flamingly stupid of course?

What an effed up world we live in, eh?

    look: sometimes kids do things without class and they learn the hard way…let them do it

    Wow, that’s a tough one. Man have times changed. I’d probably need to know a little more about the girl before I decided what type of punishment was right for her. For the boys I would have to say that the punishment should be dependent upon what they did with the photos after they received them. The girl sent out the photos to these boys so they had no control over whether or not they would get them. What they could control is what actions they take with them once they are in their possession.

    she should be punished for child porn. but i don’t see how they could do anything to those she sent the pix to, unless there was a way to prove they requested it.

    I think that this should have been handled between the parents and the child. You can not punish those that received the text because they did not actively seek them out.

    In my opinion I don’t think its a crime, but I do kinda feel sorry for this girl…shes 15!?! And obvoisly craving some attention (not in a good way) – It makes me feel sad :( as for punishment – maybe some counseling…

    I certainly don’t think its appropriate, and the parent should deal with the matter, but as far as a legal issue, I’m not sure it should be

    Taking and sending? Perhaps court-mandated sessions with a shrink. Maybe not. Maybe a trip to the local ‘working corner’ to show her what the next logical step would be. Joking!
    Receiving? No way. That’s dumb.

    Some of the kids who received the photos may not have realized what they were receiving and I think that it should be determined if they were active participants or innocent bystanders. As to her, I think that she needs some serious counseling and probation.

    I think children should NOT have any cell phones at all! Back in the day we did not have any of this crazy technology and we were safe. Nowadays, it’s a whole different story. Kids should not have any high priced, expensive electronic item that they could break or even do outrageous stuff like that.

    I think she needs to be punished. But I do agree, don’t punish the receivers unless you have proof the requested the photos or forwarded them to others knowing she is a minor. I would be so angry if a kid did that to my kids!!! Grrr.

    This young girl needs direction. If I were the judge I would take away the girls cell phone and internet capability. I would intervene with top notch counceling. It is apparent this girl needs some direction and guidance.

    I don’t see how you punish the other girls for what someone sent them on their phone. That makes no sense to me. Punish the perpetrator. Take away her cell phone for a year. Give her community service, maybe with abused children.

    Unbelievable. Sounds like someone looking for attention and she got it. She should be disciplined. As to the people who received teh pictures, I can’t see how they could be punished.

    To prosecute this as a crime seems excessive. As a parent, you have many options available. Take away the phone, anyone remember being grounded? Does anyone do that anymore? I love Christie’s idea about Community Service. I had an abused friend and experienced things that opened my eyes.
