Wrong Man Gets Arrested in “Swings Baby by the Arms” video

December 8, 2008 by Eliza Ferree

The man that swung his baby around by the arms like a rag doll video is finally getting action from the authorities. Yes,the authorities have figured out who uploaded the video.  The man published a video a few months ago and showed all of the world, of course watching a baby swing in the air by the arms is nothing we wanted to see and everyone screamed for justice. Justice has finally been reached, a man actually re-submit the video at another video-sharing site where he was caught.

His name, Chris Illingworth, age 60 of Queensland. The original video was shared over at Liveleak and it was once again being shared at a Britain site, I’m guessing he never thought anything of it. He is now being charged with child-abuse, his court date is December 18. This is not the same guy in the video, but one that did submit the video to another site. So, if this isn’t THE MAN in the video who is he really. According to Chris he’s just a man that was uploading a common interest story.

He said that since being charged he could not eat, sleep or work and was worried his children and people in the local community would think he was a pedophile.

“I’ve had to go down to the hospital, my blood pressure is 160/108 and I’m on blood pressure pills and valium – all because of this,” he said.

“Do they realise what pain they put someone through? I could fall over dead over this. I can’t even get the office work done. I’m just a zombie.”

“It’s going to ruin my f—ing life and everything. I’m 60 years old and what did I do wrong?” Illingworth said.

“I didn’t make it, I didn’t play with a baby, I just uploaded it [the video clip]. It’s nothing sexual or anything else – just a smiling baby.”

I don’t know about you but I want THE MAN in the video arrested. What do you think? Is this guy just a victim of re-loading, or should he be punished? Keep in mind this guy is not the man in the video and doesn’t even know that guy.

Grrr, this is one of those stories that really gets my back up. I don’t think the one who re-uploaded the video should get in trouble. It’s the ball-less man who made the video that needs to be arrested and brought to justice.

  2. bellava says:

this video was ripped originally from metacafe and it was also seen on YouTube,as well as at least 10 other sites prior to the LL posting. the man in the video is a circus performer and was traced to Russia by Interpol. Liveleak and the poster of the vid had given all the info to the UK police immediately after the video was posted, with a plea to the public to see if anyone knew the father and also that the practice was dangerous. Liveleak is a news based video site. Why can they not report the news ,but the video was seen all over US news stations. My heart goes out to Mr.Illinworth who is being wrongly persecuted. It seems the reach if Interpol does not stretch to Russia. If you are Australian I would be very careful about what videos you choose to expose as newsworhty.

How long does it take you to revise a store given the facts?

“The man that swung his baby around by the arms like a rag doll video is finally getting action from the authorities.”

    No he isn’t…

  4. Wathoe says:

I know Chris and this artical is very misleading. Chris found this vid on utube and up loaded it else where as a news story. He is a law abiding family man who made a mistake in uploading it to another site. He didn’t make the video, he doesn’t know anyone involved in the video and has nothing to do with the video.
He is completely upset that these charges have been made – just as you or I would if we uploaded a video from one place to another then had our house and office raided and be accused of child abuse.
Be very careful in what you look at on the net – you could be next.

  5. Eliza says:

I was actually updating this article this morning, but wanted to add that I did mean the video was getting action. Unfortuneatly I doubt the original poster will ever get arrested, it sounds like he was very clever in hiding who he was. I do feel sorry for Chris Illingworth, it sounds like all he was doing was uploading a video that he saw everyone was searching for or thought was funny.

  6. The publisher of this article to check their facts before publishing articles like this get this person or the owner of this website into some serious trouble and find themselves libel and facing legal action for defamation of character.

This article is severely contradictory to the quoted source article. The source article clearly states:

“It is understood that he had no involvement in the creation of the video”

  7. Gayla says:

Wonder if they are trying to use this method as a smokescreen to lure out the true offender?

  8. Eliza says:

I think it is possible, not to mention they are showing the world that they are looking at any leads. It is too bad Chris got pulled in though.

    http://www.babylune.com/liveleak-owner-says-chris-illingworth-is-innocent/

  9. Eliza, I think you will find that never at any stage did Chris Illingsworth find the video funny, from my understanding he uploaded it as a ‘news item’, with a disclaimer and a warning that this was a dangerous thing to do with a child.

Never at any stages that am I aware of did Chris upload the video to Liveleak for ‘entertainment value’.

If it wasn’t for people like Chris uploading the video onto Liveleak, it would never have got the attention it did. How come the Baby swinging video didnt get this type of attention from Child Protection Agencies & Police before when it was just on Youtube & Metacafe & BEFORE it was ever uploaded to Liveleak?

I will tell you why they did this, because Task Force Argos (Queensland Police) could not go after the producer & uploaders because they were not from Queensland and the offenders were well outside their grasp & jurisdiction.

Chris so happens to be from the state of Queensland, the only state in Australia and place in the world that has these types of laws. Anyone from this police state can be arrested now for simply clicking on a link to that video & accessing it. What if you click a wrong link by mistake & got that video file on your computer & the police raided you? Your busted!

Now many Australians feel like they are walking through a minefield & could stumble on something and have this sort of crap blow up in their face at any time now because of these stupid laws & a world going crazy on political correctness.

Where will this politically correct craziness end? when we have absolutely no rights & freedoms on the internet left at all?

There is strong growing belief that Chris Illingsworth is also being made a scapegoat for the Australian Federal Governments new plan & proposal to bring in mandatory internet censorship. But this censorship is NOT just limited to child abuse, they are trying to implement censorship to filter out any site the government doesn’t like. such as protest sites & anti-war/anti-government sites.

It all sounded good on paper at first, but when you examine the details in the governments proposal more closely and the report from the trials they conducted, you quickly realise the firewall they want to implement will ruin the internet, slowing some internet services like dial-up to as low as 22% of their normal speed.

The firewall will also be useless because the worst pedophiles on the internet are using private networks (VPNs) & peer-to-peer file sharing networks to share illegal media. You will hardly ever find Child Abuse/Child Sexual Abuse Materials on a regular website

    See this news item:
    http://www.news.com.au/story/0,27574,24783972-421,00.html

“AFP high-tech crime operations national manager Neil Gaughan said the child porn network had operated via the “peer-to-peer” file sharing network eMule”

  10. Wathoe says:

    Eliza,
In November you posted another artical on this topic which included the clip of the vid which you downloaded from liveleak then uploaded to this site. That is exactlly what Chris did.
I didn’t click on the video to watch it as I could be arrested for doing that and be charged with child abuse like Chris.
I hope now you can see why so many people can’t believe why this is happening.
By the way I hope you don’t live in Queensland.

  11. PiRaTeCoPy says:

its right that the video was uploaded, in order to expose any “child abuse” in the real world. if anything chris should be respected for helping to expose the perpetrator, the publicity that this has brought about has all but identified the man involved but sadly for the over zealous TFA have gone for the easy option on a technicality, leaving chris with certain immoral implications that he is in no way involved

  12. PiRaTeCoPy says:

we need a neutral no mans land between the virtual world and the real world, and a bunch of translators and negotiators to debrief us before we travel from one to the other..this is nothing more than the explotation of the weekness of the legestation relating to the REAL problems of internet obuse. the net is a one world environment, governed by different rules by each individual country….this system has to change.

  13. Joe Smith says:

It was hayden hewit who originally CONTACTED THE POLICE in this matter. His intent was to have the uploader apprehended. So now, he and his liveleak lackies are myfied and mad because the police did what they requested? It was the guy who uploaded the video (Illingsworth) who tried to be helpful, and gave the URL to where he had gotten the video from.
HAyden hewwits argument that Illingsworth is innocnet is correct, but not for the reasons he states. It is Hayden who is guilty here. He’s the one who set this whole thing in motion. Had he simply removed the video, it would have ended there. His actions are akin to joe citizen buying drugs on the street, and then taking them to the police and telling them hwhat he had done.
It’s niave at best, and flat out ignorant at worst.

I would strongly suggest that any other liveleak uploaders seriously re-consider using liveleaks site, if this is how it is managed. Anything that hayden may consider suspect, is likely to get you handed over to the law.

  14. Joe Smith says:

It has been funny to watch the debate on this subject, on the liveleak website. Any dissenting opinion is quickly deleted from the site. Crying fowl against censorship, with censorship? if ahyden/liveleak’s intent was to get the uploader busted, how could they not consider MR.Illingsworth, as he too was an uploader of the video? How irresponsible is that?

If there is any outrage here, it should be directed at the liveleak staff responsible for getting this travesty strated by getting the law involved. the video was questionable as child abuse. very questionable. While obviously irresponsible, the child was not injured. In fact, the baby seemed to enjoy the swinging. hayden should have just removed the video, if there were so many complaints about it. instead of trying to play rightous gaurdian of the internet.
Now, all that he’s accomplished is to get a member of his own “community” arrested and the man’s life destroyed. It’s no wonder mr hewit is so upset, however, I think his anger should be directed toward the one responsible for MR. Illingsworth’s current prediciment: Hayden himslef.

  15. bellava says:

umm joe smith, sounds like you were booted from Liveleak for spreading those lies..LOL nice try though , now leave these nice ladies alone and spew your hate elsewhere.(and spell check is your friend)

    hahahaa

  16. Wathoe says:

    Joe Smith.
You are a little misguided in your reasoning. I would think that the reason for telling the police about this was to catch the person who made the video and who was responsible for the ‘child abuse’ – not for finding out who has watched the link and re-uploaded it on another site.
And in just about every other state of every other country in the world a person who views something like this would not be arrested for it.

I am sure the Liveleak people had no idea Chris could be arrested for looking at it and re-uploading it – nor did the rest of us. That is why this case is so difficult to understand.

Do you understand that if I go to funniest home videos website and looked at a clip where a child falls over and the parents giggle -that in this state the police could charge me with child abuse?

I doubt that the thousands of Queenslanders sitting on their computers right now would be aware of this law.
I am however sure that most people know if you buy drugs or sell drugs you are doing something illegal.

  17. PiRaTeCoPy says:

    BELLAVA

hey bell, strange that we have both found ourselves on this site, is there something that you need to tell me ?….i mean, if its a boy can we call him PiRaTe junior ?

  18. Joe Smith says:

    BELLAVA:

Actualy, I still have an actibe liveleak account. And I’ve used that site for a couple of years. Sorry to break the news to you lady, but I’m not making up “lies” or pulling that info out of my ass. i read that in one of Biggl;es9’s posts. He said that HIMSELF. I’m pretty sure HE knows more about the situtation than YOU do. HE is the one that said that haydebn from liveleak is the one who contaced the police FIRST. He got them involved. If there were a lot opf complaints about the video, he should have just removed it. Whatever his intent, he ended up ruining Biggles9’s life. Good job to him. And kudos to any fools who think that was a responsible thing to do.

    WATHOE:

I just going off what Biggles9 said him, slef about it. HE said it was hayden from liveleak who originally contacted the police, TO FIND THE UPLOADER. Biggles9 had also UPLOADED the video. if uploading that was against the law, then it was against the law for EVERYONE who uploaded, regardless of intent. Hayden must have knwon it was against the law, otherwise, why bother contacting the police? He should have just removed the video. It wasn’t a blatant case of child abuse, as any of us who have seen the video would probably agree. No, this was liveleak trying to play internet mommy. And all the did was ruin the life of one of their best contributers.

  19. Joe Smith says:

    Bellava:

Heres from Biggles himslef on, liveleak:

“No, after a lot of complaints Hayden called me and I supplied the you tube URL,
Hayden agreed to contact the US and UK authorities to try and find the up loader,
Interpol traced it to Russia but nothing could be done, it was a circus family.
Anyway one month later and $27000 they found me and used me as an example of not what to upload, very grey area, but believe me Hayden did everything in his power to advice the right people but with little response because they didn%u2019t think the video was that bad.

  20. bellava says:

I use my LL name but you want to twist things hide. LOL,what part of Biggles trying to help locate the man don’t you get? the point is that there was no criminal investigation being done , they didn’t even know there would be one, nothing was done without Chris knowing ffs, get a clue. He was helping to assist in finding the original poster in russia. no big deal . who KNEW that the police would make a clandestine investigation and use some vague law where biggles lives to charge him? certainly not anyone involved. you have your assumptions bass akward and as I said before your SOLE purpose here is to try and slander Hayden. it’s really lame and pathetic.

I sent this blog to Chris and he said **** him ,Tell him I said to go GET A LIFE.

  21. Joe Smith says:

Send it to Hayden too, I don’t care. I’m not gonna use my liveleak Id because I know that it will get banned for this.

Like I said, breaking the law, regardloess of intent, is STILL BREAKING THE LAW.

Are you really so ignorant, that you think you could break the law and then say, “well hey, wait a minute. i was tryin to do the right thing here…”

FFS, not in the real word lady.

My SOLE purpose here is to put out a part of this story that hasn’t been put out there on liveleak. I didn’t post anything that didn’t come straight from Biggles9 himself.

Save your rightious indignations for someone else . I know from being on liveleak, that you’re a liveleak apologist. That’s ok. But, unless Biggles got it wrong, then them’s the facts…as they say.

  22. bellava says:

sure thing PhiloReturns phttt, are you so thick that you can’t understand that no one knew that anyone was breaking some extremly vague interpretation of a law that no one knew about? He’s being used as a scapegoat to further a political aganda to add filters in Oz at worst, at best he is being used to justify the Task Force Argos budget. They have nothing better to do but hunt for people who do not even meet their own guidelines as abusers. So either you are the thickest person on the planet and the only one who does not see it or , as I said ,your feewings are hurt over a ban. Like Chris said ‘get a life’

  23. PiRaTeCoPy says:

    JOE SMITH

wtf is spamming this website up with LL attitude going to do ? the point in question isn’t to do with who or how the authorities got the info but what they did with it after.
if you have a problem with hayden keep it local.

  24. Wathoe says:

Joe Smith – I think you are missing the point.
There is a difference between uploading the orginial video to the internet, and re-uploading it from one site to anyother.

Chris re-uploaded the vidoe from one site to another, which here, unlike all other countries in the world, is illiagal.
I, like anyone else would presume that the athorities would be able to understand that the person who made the video, filmed it and organially uploaded it to the internet should be charged – not a man who saw it on Utube (like the millions before him)and re-uploaded it to another site as a ‘news story’
Perhaps you are part of ARGOS – cause you don’t seem to understand the difference either?

  25. Wathoe says:

lol – sorry about the spelling above :)

  26. JOE SMITH says:

    LOL@ liveleak-o-philes. completely clueless.

  27. JOE SMITH says:

    bellava:

soory lady. Not philo, and not banned either. LOL soory to burst your bubble.

  28. Wathoe says:

Joe Smith. I am not part of Liveleak – I hadn’t even heard of it til this. I just personally know Chris.
