Wrong Twin Named in Death Claim

The father of a set of twins is trying to use the excuse that the Public Defender put the wrong name on the court files and he should NOT be charged of killing his son. Now, Troy Adrian Thomas actually killed one of his twin sons, the one named Malachai, but not Matthew Thomas.

Troy actually killed one of his son’s (Malachai) after tossing him on the bed several times. He admitted to getting angry at his wife and throwing the baby on the bed a few times, in which eventually killed the infant.

When it came time to press charges the hospital sent the birth records of the deceased child, Matthew. Only problem was Troy had killed Malachai, now for many of us we are thinking okay so what he killed one of his kids take him to jail. Right? Well, the public defender wrote the hospital asking if they made a mistake, according to the hospital no. Confused yet?

The hospital claimed the fault was with the child’s mother, Wilhemina Hicks.

“Ms. Hicks, at some point shortly after filling out the birth certificates for the twins, may have either intentionally or mistakenly begun to identify each infant by the other’s name contrary to the identities she assigned each infant in the birth certificates she completed,” hospital administrator Sharon LaBelle wrote in an affidavit from the hospital attached to the pretrial motion.

The hospital states the baby that died was Matthew Thomas. So how did the father believe he killed Malachai? According to the hospital Wilhemina Hicks, the twins’ mother may have accidentally mixed them up after bringing them home and just never knew. You know this is something I’ve always wondered about but never actually heard of. Now you heard about it but it is for the worst of situations.

Well now I guess we’ll wait to hear what happens in this case. The judge has to decide whether or not to continue with the case. If the prosecution changes the name to Malachai Thomas they can go on, but if not he can drop the charges. Which of course means he can NEVER be re-charged with the crime of his other son since the name was wrong.

    What a horrible sad mess. If he killed one of those babies, he should be tried.

    Ok, how about, the state drop the charges for murdering Michael because, obviously he’s not dead. Therefore, they charged the wrong guy for the wrong crime. But, then they charge him for killing the *other* son. That’s not charging and trying him for the same crime twice, that’s two different crimes.
